1. Acceptance of Terms

These Terms of Service ("Terms") constitute a binding legal agreement between you ("User" or "You") and Minded One, LLC, a limited liability company organized under the laws of the State of Delaware, United States ("Company," "We," or "Us"). By accessing or using the website quickimage.ai and its related API services (collectively, the "Service"), you agree to be bound by these Terms.

2. Eligibility and Local Compliance (Void Where Prohibited)

The Service is controlled and operated from the United States. We make no representation that the Service is appropriate or compliant with regulations in other locations.

• User Responsibility: If you access the Service from outside the United States (including but not limited to the People's Republic of China), you do so on your own initiative and are solely responsible for compliance with all local laws and regulations.
• Prohibited Use: You agree not to use the Service if you are located in a jurisdiction where the use of AI-generated content services is prohibited, restricted, or requires government licenses that Minded One, LLC does not hold. Accessing the Service from such jurisdictions is a breach of these Terms, and you agree to indemnify Minded One, LLC against any liability arising from such use.

3. AI Services and Content

• Input and Output: You retain ownership of the images and prompts you upload ("Input"). Subject to your compliance with these Terms, Minded One, LLC assigns to you all rights to the images generated by the Service ("Output").
• License to Company: You grant Us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your Input and Output for the purpose of operating the Service and improving our AI models.
• No Guarantee: You acknowledge that AI models may produce unpredictable or non-unique results. We do not guarantee that the Output will be fit for any specific purpose.

4. Prohibited Conduct

You agree not to generate content that is: illegal, sexually explicit, hateful, violent, or infringes on third-party intellectual property rights. Minded One, LLC reserves the right to suspend or terminate accounts found in violation of this policy without refund.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDED ONE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE LAST SIX (6) MONTHS.

6. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware (or such other venue in Delaware as designated by the Company). You hereby waive any objection to this jurisdiction.
